Article 2. Description of subscription packages
DigiSolut offers three subscription packages, with detailed characteristics available on the Pricing page:

For professional customers based in another EU Member State with a valid intracommunity VAT number, self-assessment may apply in accordance with Directive 2006/112/EC; the customer must then provide a verifiable VAT number via VIES. For non-EU customers, billing is done excluding taxes.
Article 3. Order
The order is placed online from the /pricing page: the user selects a package, is redirected to Stripe Checkout to enter their payment information, and confirms their order after accepting these GTCS. The contract is concluded upon payment confirmation by Stripe.
An electronic invoice is made available in the administration area and can be downloaded at any time.
Article 4. Prices and payment terms
Payment is made exclusively by credit card via the provider Stripe Payments Europe Ltd. Banking details are never transmitted through {{COMPANY_NAME}}’s servers (PCI-DSS level 1 at Stripe).
The subscription is automatically renewed at the end of the term (monthly or annually depending on the chosen option) by recurring direct debit on the registered card, until terminated by the user. In case of payment failure, {{COMPANY_NAME}} may suspend access to the service after notification.
Article 5. Installation fees
The initial setup of a site incurs flat-rate installation fees, separate from the subscription:
- Essential: €99 HT, one-time payment;
- Boost: €189 HT, one-time payment;
- Customized: on quote.
These fees cover the initial configuration, data import, go-live, and training for taking over. They are non-refundable once the service has been set up, the user acknowledging that the service has been fully performed.
Article 6. Right of withdrawal
In accordance with Article L.221-18 of the Consumer Code, the consumer (natural person acting for purposes not related to their professional activity) has a period of fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without having to justify their decision or incur costs other than those provided by law.
This right does not generally apply to professionals. However, by exception and in accordance with Article L.221-3 of the Consumer Code, it applies to the professional natural or legal person with five (5) or fewer employees and whose contract does not fall within the scope of their main activity.
The beneficiary of the right who wishes to exercise it sends an unequivocal request to {{COMPANY_EMAIL}}. If the provision of the service has started during the withdrawal period at the express request of the client, they remain liable for a proportionate amount for the services provided up to notification of their decision.
Article 7. Cancellation and refund
The user may cancel their subscription at any time via the Stripe Customer Portal accessible from their administration area. The cancellation takes effect at the end of the paid period: no prorated refund is made for the initiated period, except in cases of force majeure or proven failure by {{COMPANY_NAME}} to fulfill its contractual obligations.
The installation fees referred to in Article 5 are in no case refundable after service initiation.
Article 8. Compliance guarantee
{{COMPANY_NAME}} is subject to a duty of means in the provision of the service. An indicative availability target of 99.5% monthly is aimed for, excluding announced planned maintenance and cases of force majeure. Any higher contractual commitments are stipulated within Customized contracts or specific SLAs.
The applicable legal guarantees (notably the guarantee of compliance of the digital service as per Articles L.224-25-12 and following of the Consumer Code) remain due in accordance with the law.
Article 9. Personal data
The processing of personal data within the framework of contract execution is described in the Privacy Policy, which is an integral part of these GTCS.
Article 10. Disputes
These GTCS are governed by French law. Consumer mediation: in accordance with Article L.612-1 of the Consumer Code, the consumer may resort free of charge to the consumer mediator to whom {{COMPANY_NAME}} is subject; the mediator’s contact details are provided upon request to {{COMPANY_EMAIL}}. The consumer may also resort to the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
In the absence of an amicable resolution, any dispute shall be brought before the competent courts of the jurisdiction of {{COMPANY_NAME}}’s registered office, subject to the mandatory rules of jurisdiction applicable to consumers.
