The present Terms of Service (“TOS”) govern access to and use of the DigiSolut platform available at digisolut.com, digisolut.fr, and their subdomains.

Article 3. Purpose of the platform
DigiSolut is a SaaS (Software as a Service) solution intended for professionals in the restaurant industry. It specifically allows for:
- publishing and managing a showcase website;
- receiving and orchestrating on-site reservations;
- collecting and qualifying contact requests (leads);
- managing a loyalty program and a customer database;
- centralizing Google reviews and utilizing decision-support tools augmented by artificial intelligence.
Article 4. Access conditions
Access to the platform and its administrative area requires account creation: the user provides a valid email address, chooses a password, and expressly agrees to these TOS as well as the Privacy Policy. Subscription to a paid plan is governed by the General Terms of Sale.
The user agrees to provide accurate and up-to-date information, to maintain the confidentiality of their credentials, and to promptly report any unauthorized use of their account.
Article 5. Prohibited behaviors
The user is expressly prohibited from:
- attempting to access restricted areas of the platform by circumventing means (injection, brute force, exploiting vulnerabilities);
- conducting unauthorized automated scraping, mass collection, or data harvesting;
- reselling, sublicensing, renting, transferring, or commercially exploiting all or part of the service without prior written permission;
- publishing illegal, defamatory, misleading, infringing content, harming third-party rights, or disturbing public order;
- using the service to send unsolicited communications (spam) or malicious content;
- harming the security, availability, or integrity of the platform.
Article 6. Intellectual property
The platform, its software components, designs, interfaces, brands, logos, and databases are the exclusive property of {{COMPANY_NAME}} or its licensors. No transfer of ownership is made: only a personal, non-exclusive, non-transferable right of use limited to the duration of the subscription is granted to the user.
The user retains all rights to the content they publish (texts, images, menus, descriptions, photographs). They grant {{COMPANY_NAME}} a non-exclusive, free, worldwide license to store, index, display, and distribute it on the platform and its subdomains, strictly within the framework of service provision.
Article 7. Liability
{{COMPANY_NAME}} provides the service "as is" and is bound by a duty of means. We cannot be held liable for indirect losses (loss of business, revenue, reputation, or data resulting from non-compliant use).
In accordance with industry practice, the total and cumulative liability of {{COMPANY_NAME}} to the user, for all damages combined, is expressly limited to the amount paid by the user for the subscription over the twelve (12) months preceding the triggering event.
Article 8. Duration and termination
The contract is concluded for an indefinite duration from the acceptance of the TOS. The user may terminate their subscription at any time via the subscription management portal (Stripe Customer Portal) accessible from their administrative area or by written request to {{COMPANY_EMAIL}}.
{{COMPANY_NAME}} may suspend or terminate the account, as of right, in the event of a material breach of the TOS, fraud, persistent non-payment, or behavior threatening the security of the platform.
Article 9. Modifications to the TOS
{{COMPANY_NAME}} may modify these TOS to reflect legal, technical, or commercial developments. In the event of substantial changes, a notification will be sent to the user via email or through an information banner on the platform at least thirty (30) days prior to the coming into effect of the new TOS. Continued use of the service after this date will constitute acceptance of the modified TOS.
Article 10. Applicable law and jurisdiction
These TOS are governed by French law. In the absence of prior amicable resolution, any dispute relating to their formation, interpretation, or execution will be brought before the competent courts within the jurisdiction of the court of appeal of the registered office of {{COMPANY_NAME}}, subject to the mandatory rules of jurisdiction applicable to consumers.
